Mishcon is at the forefront of advising clients in the developing areas of blockchain, Non-Fungible Tokens (NFTs) and other distributed ledger technologies (DLTs). Our strategic compliance business MDRxTECH helps clients by creating software, policies, strategies and products that harness the latest technologies while navigating legal complexity.  We work with clients to develop their strategy and business model so that they can take advantage of emerging technologies, in a way which has compliance at its heart.

Our IP and Commercial teams work closely with rights holders to ensure that, when devising an NFT drop, their IP rights are effectively protected. This includes crafting trade mark specifications to cover goods and services in the metaverse, and putting appropriate commercial arrangements in place to protect and maintain IP rights. Where necessary, we take swift and effective enforcement action against unauthorised use of IP, including through notice and takedown mechanisms.

We have a well-developed Advertising and Marketing offering with deep knowledge of advertising regulatory trends. The team advises businesses at every stage of their advertising and marketing development, from clearance of ad copy, through to disputes and complaints made about their advertising. We have particular expertise in the acquisition, production, licensing and distribution of content across most media networks and platforms.

Our Patents team have extensive experience in devising enforcement and patent challenge strategies, and co-ordinating multi-jurisdictional disputes. We have acted in some of the most high-profile patent disputes, including before the appeal courts. We have particular expertise in the Life Sciences sector, where specialist lawyers focus on patent, regulatory, major contract, insurance and competition law disputes. Our regular use of civil search and asset freezing orders in counterfeit pharmaceutical and agrochemical cases sets us apart from our competitors.

The Brands practice manages IP portfolios across a diverse range of sectors, advising on matters such as advertising and domain issues, and working alongside other teams such as Competition, Reputation Protection, Commercial and Data. Our commercial team provides advice on the full range of brand and IP contract services ranging from franchising, licensing, agency and distribution agreements to sponsorship and merchandising agreements.

Additional Services

Our Sports team has been involved in several recent major legal developments as evidenced by our work on the first billion-dollar OTT/streaming boxing broadcasting deal. We have seen growth across our sports technology/data and sports regulatory business. The team increasingly advises on emerging technologies within the sports sector, such as NFTs and fan tokens.

Data protection, privacy and cyber-security breaches: our wide-ranging data experience sees us acting for data controllers, processors and subjects on a wide range of data protection and information law issues. We advise clients across a variety of sectors and provide thought leadership, including on the significant issues raised by AdTech, big data, AI and blockchain.
